Dell settles deceptive practices lawsuit for $3.35 million

Dell has received a legal slap on the wrist, agreeing to pay a $3.35 million settlement as a result of a lawsuit brought against the company, alleging deceptive trade practices including failures to deliver on rebates, provide warranty service, and abide by the terms of financing agreements. Of that settlement money, $1.5 million will go to affected consumers in the states Dell settled with. The balance will go to the states to pay for ongoing monitoring of Dell's business, in order to guarantee that it does not engage in these deceptive practices in the future. As part of the settlement, Dell agreed to certain procedures it would follow in order to curb its abuse of consumers. Some of the stipulations include 30 day limits on the time Dell has to respond to warranty claims and to issue some rebate checks.

The settlements are with the individual states that brought claims against the computer manufacturer, so if you think you've been affected and want to claim some restitution, you'll have to get in touch directly with your state's Attorney General's office. Right now, all states except for Georgia, New Hampshire, and New York have reached agreements with Dell.

HAD ALL KINDS OF TROUBLE WITH MY DELL COMPUTER.THEY TRIED TO FIX IT SIX TIMES NEVER DID.THEY HAD ME SEND IT BACK TO THEM AND OF COURSE IT GOT LOST.THEY NEVER FOUND IT YET.

We have had Dell attempt to repair our computer several times to no avail. We even had to purchase an additional warrenty because they said ours had just expired. We are still waiting for someone to actually fix our computer. Lord knows we paid enough for it.

Every vendor has its problems and its nightmare stories. Every company goes through its ups and downs. Every company gets sued. it is called humanity, we are imperfect. It does suck when it happens to you and yes it is not fair, and yes you deserve justice. but the we don't live in a fair world.

Call center employees sue Dell Philippines

One of the biggest call center firms in the country is in hot water. Seventy call center employees yesterday filed a legal suit against Dell International Services Philippines, a leading business process outsourcing company, for alleged illegal dismissal.

Together with their lawyers, the dismissed Dell employees trooped to the National Labor Relations Commission (NLRC) office in Quezon City to file the case of "constructive dismissal" against their foreign employer.

Dell corporate communications head Hector Jimenez said they could not comment at this point because they have not received copies of the complaints. "But we are checking with our lawyers on what action we will take," Jimenez added.

In two-separate complaints, the call center employees said they were dismissed from the company last April 19, which they claim is in violation of employment contracts.

The dismissed workers are seeking immediate reinstatement, full payment of their back wages as well as moral and exemplary damages.

Labor Secretary Marianito Roque, said the termination of the said employees was not mass retrenchment and has nothing to do with the prevailing global financial crisis.

"It cannot be considered a mass retrenchment because the number is very small compared to the 4,000 workforce of Dell in the country," Roque said in an interview. - With Mary Ann Reyes

what can i do i can not fight them allow i have no more money to buy another pc i have spent 2 yr fighting with dell to make this right please help me thank you Yvonne

i have been working with dell for 2 yrs= bought a vista inspiron 531 tag# J48R2F1 had nothing but trouble with it the sent me another tower same problem black screen , sometimes i get lines differ colors black out i have to turn off hit any key after it come back on i get the reg screen work ok for awhile then start over dell said buy cyberdefender i did still didn't help 200.00 later ,then the sent a dell man he replace mother board same problem came again replace the hard drive, still having trouble said it was soft work cost me another 70 still having trouble when i get done this well cost me 1000 and 1000 of dollars
